[42 N.Y.2d 840 Page 840] Appeal from a determination of the Board of Education of the Valhalla Union Free School District, rendered following an order of the Appellate Division of the Supreme Court in the Second Judicial Department, entered June 21, 1976 (53 A.D.2d 674), which in a proceeding pursuant to CPLR article 78 (transferred to the Appellate Division by order of the Supreme Court at Special Term, entered in Westchester County), (1) annulled, on the law, a determination of the board finding petitioner guilty of the charge that she was legally incompetent to perform her assigned duties due to lack of appropriate certification, and dismissing her from her position as a teacher, and (2) directed petitioner's reinstatement with back pay, less the compensation earned by her in other employment and less unemployment benefits received by her. Petitioner was a high school French teacher who was certified by the State to teach French, and who had been granted tenure by the board on September 1, 1972. In May, 1974 the board passed a resolution abolishing one foreign language position in the high school and on July 11, 1974 the board passed a resolution discontinuing the teacher with the least seniority in the secondary tenure area and reassigned petitioner to fill the position of the discontinued teacher, who had been an English teacher.
